Know the cost of getting it wrong
UAE VAT Penalties
VAT penalties in the UAE are not theoretical. Late registration alone costs AED 10,000, and the fines stack: filing late and paying late are penalised separately. The good news is that voluntary disclosure almost always costs less than waiting for the FTA to find the problem. Here is the full picture.
The penalty table
What each violation costs
These are the penalties businesses actually face. Note how filing and payment are penalised independently.
Late registration
AED 10,000. Applied when you cross the AED 375,000 threshold and miss the 20-business-day registration window. One of the most common and most painful fines we see.
Late filing
AED 1,000 first offence, AED 2,000 for a repeat within 24 months. Applies per return, including nil returns you thought you could skip.
Late payment
14% per annum on the unpaid VAT, accruing until paid. Filing on time but paying late still triggers this in full.
Failure to keep records
AED 10,000 first offence, AED 50,000 for repetition. Tax invoices and supporting records must be kept for 5 years.
Incorrect tax return
Penalties scale with the underpaid tax. Submitting a return with errors the FTA later finds costs far more than correcting them yourself first.
Obstruction
Hindering FTA officers during an audit carries its own penalties. Cooperate fully, even when the findings look bad.
Pay less, legally
Voluntary disclosure: the cheaper path
If you spot an error in a filed return, the voluntary disclosure process on EmaraTax lets you correct it before the FTA finds it. Penalties for voluntarily disclosed errors are consistently lower than penalties imposed after an FTA discovery or audit. The disclosure must be complete and honest, partial corrections that hide bigger issues backfire.
Time matters. Disclosing in the next tax period costs less than disclosing a year later. If you are unsure whether something needs disclosing, ask first, our VAT team reviews positions like this every week.
Fighting a penalty
Reconsideration and appeals
Received a penalty you believe is wrong? You can request reconsideration by the FTA, and if that fails, appeal to the Tax Disputes Resolution Committee. Deadlines for each stage are strict, usually 20 business days from the decision, so act fast.
- Document everything before you challenge, assumptions lose
- Pay first where required, then dispute, it stops interest accruing
- Meet every deadline, late appeals are rejected outright
- Show reasonable cause with evidence, not just disagreement

In detail
How penalties are actually calculated
The headline numbers are only the start. Here is how the FTA applies them in practice.
Late payment maths
The 14% per annum accrues daily on the unpaid balance from the day after the deadline. A AED 50,000 liability paid 3 months late costs roughly AED 1,750 in penalties alone, before any filing penalty.
Stacking
Filing late and paying late are separate violations. A return filed 10 days late with payment 10 days late attracts both the AED 1,000 filing penalty and the accruing payment penalty. They do not cancel each other out.
Repeat offences
The higher repeat rates apply when the same violation recurs within 24 months. Two late filings 18 months apart means the second costs AED 2,000, not AED 1,000. The clock runs per violation type.
Tax evasion
Deliberate evasion is a different category entirely, with penalties up to 300% of the unpaid tax plus potential criminal referral. This is why honest voluntary disclosure matters so much.
Record-keeping
The AED 10,000 failure-to-keep-records penalty applies per instance the FTA establishes. In practice it is usually applied once per audit, but repeated non-compliance across periods can multiply it.
Interest on penalties
Unpaid penalties themselves can accrue further charges. Pay assessed penalties promptly even while disputing them, you can recover the amount if the appeal succeeds.
Prevention
A penalty-proof compliance calendar
Almost every VAT penalty we see traces back to a missed deadline, not a complex technical dispute. A simple compliance calendar prevents most of them. Mark these dates the day your TRN is issued: registration anniversary for record reviews, each tax period end date, the 28-day filing deadline after each period, and the payment date (same as filing, but treat it as a separate task).
Assign one person clear ownership of the calendar, with a backup. Shared responsibility means no responsibility. Set reminders at 14 days, 7 days, and 2 days before each deadline. The 14-day reminder is for preparation, the 7-day for review, the 2-day as a final safety net. Businesses that run this simple system rarely pay a single dirham in penalties.
If managing this in-house feels fragile, that is exactly what outsourced compliance is for. Our VAT services include deadline tracking, return preparation, and filing, so penalties become our problem to prevent, not yours to pay.
Real scenarios
Penalty scenarios we see most
These are the situations that actually land on our desk, with what each one cost.
The late registrant
A trading company crossed AED 375,000 in month 8 but registered in month 14. The FTA backdated the liability and applied the AED 10,000 late registration penalty plus required returns for the missed periods. Total cost including advisor fees to fix it: over AED 18,000.
The forgotten nil return
A consultancy with no sales in Q2 assumed no return was needed. The AED 1,000 late filing penalty arrived automatically. The fix took 10 minutes on EmaraTax, the lesson lasted longer.
The spreadsheet rounder
A retailer calculated VAT in spreadsheets with rounding at line level instead of invoice level. Across thousands of transactions the underpayment added up, and the FTA assessment included penalties on the full shortfall. Proper accounting software would have prevented it entirely.
The voluntary discloser
A logistics firm found it had missed reverse charge on AED 400,000 of imported services. Voluntary disclosure cost the VAT plus a reduced penalty. Had the FTA found it first during the audit that was already scheduled, the penalty would have been a multiple of what they paid.
The record-keeper
During an audit, a restaurant could not produce supplier invoices for 40% of its input VAT claims. The claims were disallowed in full, plus the failure-to-keep-records penalty. Five years of records is not optional.
The successful appeal
A manufacturer received a penalty based on a liability date it could prove was wrong, with dated contracts and bank statements. Reconsideration succeeded and the penalty was cancelled in full. Evidence wins appeals, arguments do not.
VAT Administrative Penalties FAQs
Questions about vat administrative penalties
What is the penalty for late VAT registration in the UAE?
AED 10,000. It applies when you exceed the AED 375,000 mandatory threshold and fail to register within 20 business days. It is applied automatically once the FTA establishes the liability date.
How much is the late filing penalty?
AED 1,000 for the first offence and AED 2,000 for a repeat offence within 24 months, per return. This applies even to nil returns.
What is the late payment penalty?
14% per annum on the unpaid VAT amount, accruing until the liability is settled. Filing on time does not protect you if the payment is late.
Can VAT penalties be reduced or waived?
Penalties imposed after voluntary disclosure are lower than those imposed after FTA discovery. You can also request reconsideration of a penalty decision, and appeal to the Tax Disputes Resolution Committee if reconsideration fails.
How do I correct an error in a filed VAT return?
Through voluntary disclosure on EmaraTax. Do not re-file the return. Disclose fully and promptly, partial or delayed disclosures attract higher penalties.
How long do I have to appeal a penalty?
Strict deadlines apply at each stage, typically 20 business days from the decision. Late appeals are generally rejected, so start immediately.
